These terms apply to the use of Pixavo, offered by Pixavo, eenmanszaak (Klaproos 21, 7483 AR Haaksbergen, Netherlands; KvK 87989700; VAT ID NL004519220B66). By creating an album you agree to them.
The service
Pixavo lets you create a shared photo and video album for a wedding or other celebration. Guests upload via a unique code; the images appear in a live feed. Afterwards you can download everything in full quality.
Purchase and payment
You pay once per event, via Stripe. There is no subscription and no automatic renewal. The payment gives access to creating and using one album, according to the chosen package.
What you get
Your album can be viewed online according to your package: Basic for 6 months, Premium for 12 months and Premium Plus for 3 years after the date of your event. During that period you can download the photos and videos in full quality to keep forever. The prices are one-off: Basic £49, Premium £79 and Premium Plus £139. You can see the exact contents of each package (capacity, videos, options) when you create the album.
Your photographer's photos and storage
Photos are unlimited in number. Basic and Premium include 3 GB of photos per album and a fair-use limit of 300 photos per device per hour; that is plenty for the photos of all your guests. Large series in full quality, such as a professional photographer's delivery, fall outside this: you upload those with Premium Plus, which includes Photographer upload as standard. If someone tries to upload such a series to an album on Basic or Premium, that upload is paused and we offer the Photographer upgrade to Premium Plus for a fixed one-time amount shown at that moment; photos already in the album stay where they are. Storing and processing images costs money; these limits keep the service affordable for everyone. Video has its own time budget per plan.
After the storage period ends
When the storage period of your package ends, your album can no longer be viewed online, and the album and all its images are then permanently deleted — at the latest within 90 days after that date. That deletion cannot be undone, so download your album well in time. We send you a reminder by email beforehand, about a month before the storage period ends.
Keep your own originals
Pixavo is a sharing and viewing service — not a backup service and not an archive. Your album stays online for as long as your package runs; the full-quality download is your own archive. So always keep the original photos and videos on your own phone, computer or backup, and download your album well before the end of the storage period — we email you when that date approaches. No online service can entirely rule out a technical fault, an upload that never completed on a guest’s phone, or data loss. Your own copy is the only real certainty, so never assume Pixavo is the only place your images exist.
Satisfaction guarantee
We stand behind the service with a simple money-back guarantee. If you’re not happy with your album after your event, for any reason, you get the full purchase amount back. We only ask that you gave the album a fair chance: that your event took place and that you shared the QR code or the share link with your guests, so they could actually contribute. Send your request to support@pixavo.io within fourteen days of the event. The guarantee applies once per album and does not affect your statutory rights as a consumer.
Right of withdrawal
As a consumer you have a statutory right of withdrawal: up to fourteen days after purchase you can cancel the purchase without giving any reason. Email support@pixavo.io and we will refund the full purchase amount. If your event already took place within those fourteen days, you can also always fall back on the satisfaction guarantee above.
Your role as organiser
You manage the code and decide who you share it with. You are responsible for how your guests use the album. You have moderation tools to hide or delete an item, and you can switch on pre-approval so that uploads only appear after you have approved them.
Responsibility for uploads
Everyone who uploads something to an album is personally responsible for that upload. By uploading, the uploader confirms that they took the images themselves or have permission to share them, and that the images do not infringe the rights of others, such as copyright, image rights or privacy.
Pixavo is a technical service that stores and displays uploads. We do not review uploads in advance and are not responsible for their content. As organiser you are responsible for who you give access to the album and for how your guests use it; the moderation tools above are there for that purpose.
If a third party holds Pixavo liable because of content that you or one of your guests uploaded, you will not hold us liable for it and you will compensate the reasonable costs we incur as a result, unless the claim is attributable to Pixavo itself. For consumers this applies to the extent permitted by law.
Permitted use
The album is intended solely for photos and videos of the event it was created for. The following is in any case not permitted:
- using the album as a general storage, backup or file-sharing service, or for images that have nothing to do with the event;
- unlawful, infringing, threatening or criminal content, including images that infringe the rights of others;
- automated or bulk uploading, spreading malware, or otherwise disrupting or overloading the service;
- commercially reselling the album or its storage capacity, or making it available to third parties outside the event.
The storage capacity belongs to the chosen package and is intended for normal use around one event. If these terms are breached, we may hide or remove content, temporarily close or permanently terminate an album, and refuse further service. In cases of serious misuse the right to a refund lapses, and we report criminal offences to the authorities. Your statutory rights as a consumer remain unaffected.
Reporting unlawful content
Do you see content in an album that you believe is unlawful or infringes your rights? Email support@pixavo.io with the album code or link, a description of the content and why it is unlawful. We assess every report carefully and as quickly as possible, hide or remove content where warranted, and let you know what we have done. This email address is also our point of contact for authorities.
Ownership of the images
The photos and videos remain the property of their creators and of you as organisers. We claim no ownership of your images and do not use them for any purpose other than providing the service.
To be able to provide the service, you grant Pixavo (and your guests grant, by uploading) a limited licence to store the images, process them technically (such as resizing and transcoding for display) and show them to the people with access to the album. This licence serves that purpose only and ends as soon as the images are deleted.
Security and confidentiality
We take appropriate technical and organisational measures to protect your album and your images, such as encrypted connections and carefully chosen storage partners. At the same time, no online service can be secured 100%. We therefore cannot guarantee that data will never be lost, leaked or accessed by unauthorised parties. If that nevertheless happens, we act in accordance with the applicable rules (including the obligation to report data breaches), but our liability is limited as described in the “Liability” section.
Also bear in mind that an album is accessible to everyone who has the code or share link. You decide who you share it with. What guests then do with images they see in the album, such as downloading, taking screenshots or forwarding them, is outside our influence and responsibility. If your event includes moments that must not be spread further, use the moderation tools, switch on pre-approval and share the code deliberately. The responsibility for those choices lies with you as organiser and with your guests, not with Pixavo.
Liability
We do our best to keep the service running reliably, including under heavy load and poor wifi, but we cannot guarantee that it is always available without interruption or fault. Should something nevertheless go wrong, the following applies. We are not liable for indirect or consequential loss; this includes in any event missed or lost images, the cost of re-taking or commissioning new footage, lost profit and non-material damage. Our liability for direct loss is limited, per event and per album, to the amount you paid for that album. In assessing any loss, account is taken of whether you kept your own copy of your images, as asked in the section ‘Keep your own originals’.
These limitations do not apply in the event of intent or deliberate recklessness on our part, nor to damage arising from death or personal injury. Nor do they apply to the extent that mandatory consumer law precludes them: your statutory rights as a consumer — including repair, replacement, price reduction or rescission where the service does not deliver what was promised — continue to apply in full, alongside the satisfaction guarantee and the right of withdrawal above.
Force majeure
We are not liable for failing to perform our obligations, or performing them late or incompletely, as a result of force majeure. This includes in any event a fault, outage, data loss or discontinuation at the partners Pixavo runs on — the hosting, storage, video and payment services — as well as internet and power outages, cyber attacks, fire, government measures and war. If the force majeure lasts so long that we can no longer deliver your album, we refund the purchase amount pro rata to the remaining storage period.
Changes and termination
We may amend these terms and the service. We will inform you of material changes. You can have your album deleted at any time via support@pixavo.io.
Language
These terms exist in several languages. For pixavo.io the English version is leading; if language versions differ, the English text prevails.
Governing law
These terms are governed by Dutch law. If you are a consumer, you also keep the protection of any mandatory consumer law of the country where you live.
