These terms apply to the use of Pixavo, offered by Pixavo, eenmanszaak (Wegtersweg 38E, 7556 BR Hengelo, Netherlands; KvK 42026821; VAT ID NL869367122B01). By creating an album you agree to them.
The service
Pixavo lets a couple create a shared photo and video album. Guests upload via a unique code; the images appear in a live feed. Afterwards you can download everything in full quality.
Purchase and payment
You pay once per wedding, via Stripe. There is no subscription and no automatic renewal. The payment gives access to creating and using one album, according to the chosen package.
What you get
Your album can be viewed online according to your package: Basis for 6 months, Premium for 12 months and Premium Luxe for 3 years after the wedding date. During that period you can download the photos and videos in full quality to keep forever. The prices are one-off: Basis $59, Premium $89 and Premium Luxe $149. You can see the exact contents of each package (capacity, videos, options) when you create the album.
Keep your own originals
Pixavo is a sharing and viewing service — not a backup service and not an archive. Your album stays online for as long as your package runs; the full-quality download is your own archive. So always keep the original photos and videos on your own phone, computer or backup, and download your album well before the end of the storage period — we email you when that date approaches. No online service can entirely rule out a technical fault, an upload that never completed on a guest’s phone, or data loss. Your own copy is the only real certainty, so never assume Pixavo is the only place your images exist.
Satisfaction guarantee
We stand behind the service with a simple money-back guarantee. If you’re not happy with your album after your wedding day, for any reason, you get the full purchase amount back. We only ask that you gave the album a fair chance: that your wedding took place and that you shared the QR code or the share link with your guests, so they could actually contribute. Send your request to support@pixavo.nl within fourteen days of the wedding. The guarantee applies once per album and does not affect your statutory rights as a consumer.
Right of withdrawal
These terms are governed by Dutch law, and it gives you a fourteen-day right to cancel: up to fourteen days after purchase you can cancel without giving any reason. We apply that to every buyer, wherever you live. Email support@pixavo.nl and we will refund the full purchase amount. If your wedding already took place within those fourteen days, you can also always fall back on the satisfaction guarantee above.
Your role as organiser
You manage the code and decide who you share it with. You are responsible for how your guests use the album. You have moderation tools to hide or delete an item, and you can switch on pre-approval so that uploads only appear after you have approved them.
Permitted use
The album is intended for images of the wedding in question. Unlawful, infringing or offensive content is not permitted. We may hide or remove content that breaches the terms, and in serious cases close an album.
Ownership of the images
The photos and videos remain the property of their creators and the couple. We claim no ownership of your images and do not use them for any purpose other than providing the service.
Liability
We do our best to keep the service running reliably, including under heavy load and poor wifi, but we cannot guarantee that it is always available without interruption or fault. Should something nevertheless go wrong, the following applies. We are not liable for indirect or consequential loss; this includes in any event missed or lost images, the cost of re-taking or commissioning new footage, lost profit and non-material damage. Our liability for direct loss is limited, per event and per album, to the amount you paid for that album. In assessing any loss, account is taken of whether you kept your own copy of your images, as asked in the section ‘Keep your own originals’.
These limitations do not apply in the event of intent or deliberate recklessness on our part, nor to damage arising from death or personal injury. Nor do they apply to the extent that mandatory consumer law precludes them: your statutory rights as a consumer — including repair, replacement, price reduction or rescission where the service does not deliver what was promised — continue to apply in full, alongside the satisfaction guarantee and the right of withdrawal above.
Force majeure
We are not liable for failing to perform our obligations, or performing them late or incompletely, as a result of force majeure. This includes in any event a fault, outage, data loss or discontinuation at the partners Pixavo runs on — the hosting, storage, video and payment services — as well as internet and power outages, cyber attacks, fire, government measures and war. If the force majeure lasts so long that we can no longer deliver your album, we refund the purchase amount pro rata to the remaining storage period.
Changes and termination
We may amend these terms and the service. We will inform you of material changes. You can have your album deleted at any time via support@pixavo.nl.
Governing law
These terms are governed by Dutch law.
